By accessing or using AutoBetr ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations.

2. Privacy & Data Collection

Your use of AutoBetr is also governed by our Privacy Policy. By using our service, you consent to the collection, use, storage, and sharing of your information as described in our Privacy Policy.

We may collect and use your data for any lawful business purpose, including but not limited to:

• Account information (name, email, location)
• Payment information (processed securely by Stripe)
• Usage analytics (cookies, session data, behavior tracking)
• Product improvement and development
• Marketing and promotional purposes
• Sharing with third-party service providers
• Compliance with legal obligations
• Any other purpose permitted by law

By using AutoBetr, you grant us a perpetual, worldwide, royalty-free license to use your data in accordance with applicable laws and our Privacy Policy.

Marketing Communications: By creating an account, you consent to receive:

• Transactional emails (receipts, account updates, service notifications)
• Marketing emails (promotions, new features, product updates)
• Product announcements and beta invitations

You may opt-out of marketing emails at any time, but cannot opt-out of transactional emails required for account management.

AutoBetr is an educational analytics tool only. We do NOT provide:

• Financial advice
• Investment advice
• Trading recommendations
• Guaranteed returns or predictions

All information, analytics, and predictions provided are for informational and educational purposes only. You should consult a licensed financial advisor before making any trading decisions.

4. Eligibility & Geographic Restrictions

To use AutoBetr, you must:

• Be at least 18 years old (or the legal age in your jurisdiction)
• Be a legal resident of a jurisdiction where prediction market analytics are permitted
• Not be located in a restricted state (see below)

We make NO guarantees, warranties, or representations about:

• Accuracy of predictions or analytics
• Profitability of trading decisions
• Success rates or outcomes
• Availability or uptime of the service

7. "AS IS" Service - No Warranties

AutoBetr is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free service
• Accuracy, reliability, or completeness of information

8. Third-Party Prediction Market Platform Integration

AutoBetr integrates with third-party prediction market platforms including Polymarket and Kalshi. Important clarifications:

• Prediction Markets, Not Gambling: These platforms offer event contracts and prediction markets, which are distinct from traditional gambling or sports betting
• Separate Accounts Required: You must create and maintain your own accounts with these platforms
• We Are Not Affiliated: AutoBetr is not owned, operated, or endorsed by Polymarket, Kalshi, or any other platform
• Their Terms Apply: You must comply with each platform's Terms of Service
• API Limitations: Service may be interrupted if third-party APIs change or become unavailable
• No Liability: We are not responsible for actions, errors, or losses on third-party platforms
• Account Suspensions: If your third-party account is suspended/banned, we are not responsible and will not issue refunds
• Platform Restrictions: You must comply with each platform's state restrictions and eligibility requirements

You authorize AutoBetr to:

• Access market data from these platforms via their public APIs
• Display odds, predictions, and analytics based on this data
• NOT execute trades on your behalf (you maintain full control of your funds)

9. Preorder Terms & Beta Access

Founder Preorder purchases include:

• One-time payment for lifetime access (pricing displayed at checkout)
• Non-refundable after 30 days from date of purchase
• Subject to product availability and development timeline
• Estimated beta access: 2026; Full launch: 2027
• Lifetime Access Means: Access for as long as AutoBetr operates, with no recurring subscription fees
• Service Discontinuation: We reserve the right to discontinue the service with 90 days notice. No refund will be issued if discontinuation occurs after your 30-day refund window

10. Refund Policy

30-day money-back guarantee from your date of purchase applies to your AutoBetr preorder fee ONLY. We do NOT refund or compensate for:

• Trading losses
• Lost profits or opportunities
• Funds lost on third-party platforms
• Third-party account suspensions or bans
• Service discontinuation after 30-day refund period

11. User Responsibilities & Account Security

You are responsible for:

• Maintaining confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of unauthorized access
• Providing accurate and current information
• Complying with all applicable laws in your jurisdiction
• Managing your own trading decisions and risk

We are NOT responsible for:

• Losses due to stolen credentials or unauthorized access
• Your failure to secure your account
• Actions taken by someone using your account

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

AutoBetr, its founders, employees, and affiliates shall NOT be liable for any direct, indirect, incidental, special, or consequential damages arising from:

• Use or inability to use the service
• Trading losses or financial losses
• Errors, inaccuracies, or omissions in predictions
• Unauthorized access to your data
• Third-party platforms or services

Maximum Liability Cap: In no event shall our total liability to you for all damages exceed the amount you paid to AutoBetr in the twelve (12) months prior to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless AutoBetr LLC, its officers, directors, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your violation of these Terms of Service
• Your use or misuse of the Service
• Your violation of any law or regulation
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any claim that your conduct caused injury or damage to a third party
• Your trading activity on third-party platforms (Polymarket, Kalshi, etc.)
• Any dispute between you and another user

This indemnification obligation will survive termination of your account and these Terms.

14. Intellectual Property

All content, algorithms, designs, and materials on AutoBetr are owned by AutoBetr LLC and protected by copyright, trademark, and other intellectual property laws.

15. Prohibited Uses

You may NOT:

• Use AutoBetr if you are under 18 years old
• Reverse engineer or copy our algorithms
• Use the service for illegal activities
• Share your account credentials
• Scrape or automate access to our platform

16. Termination

We reserve the right to terminate or suspend your access at any time, without notice, for violating these Terms.

17. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes that substantially affect your rights, we will provide at least 30 days advance notice via email or prominent notice on our website.

Your continued use of AutoBetr after the effective date of any changes constitutes your acceptance of the new Terms. If you do not agree to the changes, you must stop using the Service and may request a refund if within your 30-day refund window.

18. Force Majeure

AutoBetr shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to:

• Acts of God (earthquakes, floods, fires, storms, natural disasters)
• War, terrorism, riots, civil unrest, or acts of government
• Internet outages, network failures, or cyberattacks
• Third-party service failures (Stripe, Kalshi, Polymarket, AWS, hosting providers)
• Pandemics, epidemics, or public health emergencies
• Power outages, equipment failures, or infrastructure damage
• Regulatory changes or government restrictions

In such events, our obligations under these Terms will be suspended for the duration of the force majeure event, and we will not be liable for any resulting delays or failures.

19. Dispute Resolution & Arbitration

20. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law provisions.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

22. No Waiver

Our failure to enforce any provision of these Terms, or to exercise any right or remedy, shall not constitute a waiver of that provision, right, or remedy. No waiver of any breach of these Terms shall constitute a waiver of any subsequent breach.

23. Assignment

We may assign, transfer, or delegate these Terms and our rights and obligations without your consent to:

• Any affiliate or subsidiary
• An acquirer of our business or assets
• A successor entity in a merger, acquisition, or corporate restructuring

You may not assign or transfer your rights under these Terms without our prior written consent. Any attempted assignment in violation of this section is void.

24. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AutoBetr and supersede all prior agreements, proposals, or representations, whether written or oral.
